(1) This website www.carinegeoffrionartiste.com and/or the services, including all mobile applications connected to it (collectively the "Services") and any offer or sale of products (the "Products") by the intermediary of the Site, are owned and operated by Carine Geoffrion artiste peintre (hereinafter also called " we”, “us” or “our”). These Terms of Business (the “Terms”) set forth the terms and conditions under which visitors or users (collectively, the “user” or “you”) may visit or use the Site and/or Services and purchase Products.

(2) By accessing or using the Services, you acknowledge that you have read and consent to these Terms and agree to be bound by them. If you do not agree to all of the Terms, you may not access the Site or use any of the Services. Read these Terms carefully before accessing or using our Site or Services, or purchasing any Products. In these Conditions, you will find out who we are, how we sell our Products to you, how you can withdraw from the purchase contract and what you can do in the event of a problem.

(3) You represent that you are of legal age and have the legal authority, right and power to enter into a binding agreement based on these Terms, to use the Services and to purchase Products. If you are under the age of majority, you may only use the Services or purchase Products with the consent of your parents or legal guardian.

The pictures and descriptions of the Products and/or Services are provided for information purposes only and do not bind us.

We invite you to refer to the information and instructions for use and/or maintenance that appear on the product description sheet on our site. We cannot be held liable for any damage resulting from non-compliance with these instructions for the use of the Products and/or Services provided on our website.

Purchase of Products

Any purchase of Products is subject to the Terms applicable at the time of such purchase.

(2) When purchasing a Product: (i) it is your responsibility to read the complete list of items before committing to purchase them; and (ii) placing an order on the site (by completing the payment procedure by pressing the "Buy" button or a similar button) may lead to a legally binding contract for the purchase of the relevant Product, unless otherwise specified otherwise in these Terms.

(3) You can choose from our selection of Products and place the products you intend to purchase in a basket by clicking on the corresponding button. The prices we charge are indicated on the Site in Canadian dollars (CAD). We reserve the right to change our prices or correct any pricing errors that may inadvertently occur at any time. These changes do not affect the price of Products that you have previously purchased. Any delivery time stated applies from receipt of your payment of the purchase price. By pressing the "Buy" button or a similar button, you place a binding order to purchase the advertised Products at the price and with the shipping costs indicated.

(4) The legally binding contract for the purchase of the products is concluded when you complete the ordering process, as described above, by pressing the "Buy" button or other similar button, as we offer a payment method which is launched immediately after submitting your order (instant bank transfer via PayPal).

Delivery of Products

Delivery to Canada is possible for all products offered. Delivery in the USA and internationally is only possible for original artworks on paper (without framing) and artprints.

Prices and delivery times vary depending on the type of Products ordered, the delivery address and the delivery method chosen :

The delivery cost is displayed at checkout. Approximate delivery times are (for information purposes only) : Canada : 5 working days, USA : 10 working days, International : 15 working days. Additional delays may occur. This is beyond our control. To these deadlines must be added 2 working days of preparation of the product. Items are sent without a tracking number, except for original artworks on canvas and wood panel (Canada only), original artworks on 5x7 paper with the framing option (Canada only).

The buyer can pick up their order in person to save preparation/delivery costs. In this case, the buyer must select the « Studio » delivery option in the shopping cart. The meeting point will be at Quartier Dix30, in Brossard.

Please take note of the applicable prices and delivery times on the Product description sheet before confirming your order. For informational purposes only. Delivery times may be longer during periods of high traffic, depending on the destination, if the products are in production, etc. Outside Canada : if taxes and/or customs fees are required, they must be paid by the buyer.

Coupons, Gift Cards and Other Offers

We may from time to time offer coupons, gift cards or discounts and other offers (“Offers”) relating to our Products. These Offers are only valid for the duration that may be indicated therein. Offerings may not be transferred, modified, sold, traded, reproduced or distributed without our express written permission.

Offers cannot be applied to products purchased prior to the start of such offers.

Refund and return policy

No returns, exchanges or refunds.

For damage during delivery and caused by the delivery service only, please contact Carine Geoffrion artiste peintre at cgartiste@outlook.com with supporting photos upon immediate receipt of the Product.

All products are carefully inspected before sending and Carine Geoffrion artiste peintre ensures that the Products are free of breakage or manufacturing defects.

- Fabric products are packed in a waterproof bag before being placed in the envelope.

- Original artworks and artprint on paper (9x12 inches and -) are packaged in a waterproof archival quality envelope and inserted between two thick cardboard sheets before being placed in the envelope. Those 11x14 inches and larger are packaged similarly, but sent as parcels.

- Original artworks on canvas and wood panel are carefully packaged for transport.

* Artworks on paper (originals and reproductions) are sold and delivered without framing or mat. The photos showing the artworks in the frame are for demonstration purposes only.

Product Warranty

Carine Geoffrion artiste peintre guarantees that the Products are sold new and inspected before sending by Carine Geoffrion artiste peintre. A slight color variation may be present between the actual color and the color presented on the pictures on the site. Carine Geoffrion artiste peintre disclaims any liability in relation to the Products sold.

In order to preserve the original artworks on paper as well as the reproductions on paper, Carine Geoffrion painter suggests that you use acid-free framing products (adhesive tape, cardboard, mat, etc.) and under a glass. It is the buyer's responsibility to properly preserve their original artworks or reproductions given that they are made of paper and that paper is a fragile medium and sensitive to the elements.

It is the responsibility of the buyer to maintain his fabric derivative product in accordance with the instructions on its label (inside), as well as on the product description sheet on the site www.carinegeoffrionartiste.com

Original artworks on canvas and wood panel come with a wire hanging system on the back. It is the buyer's responsibility to make sure the wire is in place before hanging it on the wall. The buyer is responsible for the safe hanging of the artwork on the wall. The original artworks on canvas and wood panel are also varnished in order to increase their protection against the external elements. However, the frame is made of wood, so it is not recommended that the client expose the artwork in a place of high humidity for example. Carine Geoffrion painter disclaims any responsibility for the artworks sold.

Intellectual property

(1) Our Services and related content (and any derivative works or enhancements thereof), including but not limited to all text, artworks, files, images, software, scripts, graphics, photos, sounds, music, videos, information, content, materials, products, services, URLs, technologies, documentations, trademarks, service marks, trade names and trade dress and interactive features, and all intellectual property rights therein, are owned or licensed by us (collectively, “Our Intellectual Property”), and nothing herein grants you any rights in connection with Our Intellectual Property. You shall acquire no right, title or interest in Our Intellectual Property. All rights are expressly reserved.

Acquiring a derived product or an original artwork by Carine Geoffrion artiste peintre does not give you any rights, except the right of physic ownership of the artwork in the case of an original artwork (specified in the certificate of authenticity delivered with the artwork) .

Compensation

You agree to defend and hold us harmless against any and all actual or alleged claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys' fees ) arising out of or relating to your use of the Site and Services in violation of these Terms, including in particular any use that would violate the limitations and requirements set forth in these Terms, unless such circumstances are not caused by your fault .

Limitation of Liability

To the fullest extent permitted by applicable law, we disclaim all liability for any amount or type of loss or damage which may arise to you or any third party (including any direct or indirect loss and any loss of revenue, profits, customers, data, contracts, and any loss or damage resulting from, or related to, business interruption, loss of opportunity, loss of anticipated savings, wasted management or office time , even if foreseeable, in connection with (i) this Site and its contents, (ii) the use, inability to use, or results of the use of this Site, (iii) any site website linked to this Site or the documents present on these linked websites.

We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from a cause beyond our control and/or force majeure.
You agree that the information published on this site is offered as is, in order to provide information to you, without any guarantee. Despite the desire to ensure the accuracy and updating of the content of its site, Carine Geoffrion artiste peintre assumes no responsibility with regard to errors present on the site. You agree to use this website at your own risk. Carine Geoffrion artiste peintre should in no way be held responsible for any damages that may result from the use of this website.
